Is payday lending legal in Texas?

Yes. Payday and auto title loans are legal in Texas, but the store you visit usually does not make the loan. Under Texas Finance Code chapter 393, a credit access business (CAB) arranges the loan with a third-party lender and charges its own fee for doing so. The lender's interest is capped; the CAB fee is not, which is why Texas loans of this kind are expensive.

CABs must be licensed by the Texas Office of Consumer Credit Commissioner (OCCC), post their fee schedule in each store, and hand you the OCCC's standard cost disclosure before you sign. You can look up any license in the OCCC license search.

On the OCCC's figures, the average APR is about 415% for a payday loan, 223% for an auto title loan and 180% for a pawn loan. Source: OCCC, 2025 Study of Consumer Loan Products, checked Oct 7, 2026.

Other lender types

  • Pawnshops are licensed by the OCCC under Finance Code chapter 371. The maximum pawn charge falls as the loan gets bigger, and you can walk away by giving up the item.
  • Installment lenders ("regulated lenders", Finance Code chapter 342) make loans with capped rates and fees, repaid in scheduled payments. Many of their OCCC records now show the license as moved to the NMLS system; check NMLS Consumer Access for current status.
  • Online lenders and apps lend under a Texas license, a credit services registration or through a partner bank. See online lenders and apps in Texas.
