"Loans for Seniors on Social Security: What to Know"

Lenders may count Social Security retirement income as income, and federal law limits how they may treat your age and retirement benefits. But being allowed to borrow is not the same as being able to afford it. On a fixed income, a high-cost loan can take a large share of next month's check, and the CFPB has a whole set of resources on elder financial exploitation. This guide covers the credit rules that apply to older borrowers, the scam signs to know, and where to get help. If you receive SSI or SSDI, read our separate guide on payday loans on SSI or disability.

What federal credit law says about age and retirement income

The Equal Credit Opportunity Act and its rule, Regulation B, set limits on how a creditor may judge an applicant. Three points matter for older borrowers (12 CFR 1002.6):

  • A creditor may not take an applicant's age into account, as long as the applicant has the capacity to enter into a binding contract (1002.6(b)(2)(i)). The rule has narrow exceptions, such as certain credit scoring systems.
  • A creditor may not "discount or exclude" an applicant's income because it is an annuity, pension or other retirement benefit (1002.6(b)(5)).
  • A creditor may still consider "the amount and probable continuance" of any income (1002.6(b)(5)). That is why a lender may ask for proof of your monthly benefit.

These rules apply to a creditor's decision. They do not limit what a loan may cost. Cost limits come from state law.

Why a fixed income changes the math

A retirement check usually arrives once a month in the same amount. A loan with a fee of $15 per $100 due in two weeks must be repaid from that same amount. The CFPB says state laws typically cap payday fees at $10 to $30 per $100 and that $15 per $100 on a two-week loan works out to an annual percentage rate (APR) of nearly 400 percent. Our guide on how APR works in payday and cash advance loans shows the arithmetic.

Some states build this into their rules by tying the loan to income. For example, Nevada says the monthly payment on a high-interest loan, with other loans, cannot exceed 25 percent of expected gross monthly income. See the table below. Most states in our rules data have no such cap.

Your award letter and your online SSA account show when your payment arrives. We could not load the SSA's own pages when we checked, so we do not give the payment calendar here. Ask any lender what date it will take repayment, and compare it with the day your deposit lands.

Loan scams that target older adults

The CFPB's Office for Older Americans page lists resources on preventing elder financial exploitation. They include "Money Smart for Older Adults," a fraud-prevention program, a section on finding help after elder financial abuse, and guides for banks and credit unions (CFPB, page dated May 28, 2026). Read these before you hand over any account or ID number.

The FTC describes the advance-fee loan scam: the scammer promises a loan or card, asks for an upfront "processing" or application fee, then disappears. Warning signs it lists include ads like "Bad credit? No problem" and "guaranteed," fees not disclosed before you apply, and demands for payment before the loan is delivered. It also says unsolicited calls offering credit are illegal under the Telemarketing Sales Rule, and that legitimate lenders do not guarantee approval before checking your credit history. The FTC suggests verifying the lender's registration with your state attorney general or banking regulator. If you paid by wire, cryptocurrency or gift card, act quickly and report it at ReportFraud.ftc.gov (FTC article, July 2022).

Reverse mortgages are a different product

If you own your home, you may hear about a reverse mortgage. The CFPB says only homeowners aged 62 or older can get the most common type, the Home Equity Conversion Mortgage (HECM). Interest and fees are added to the balance each month, so the balance grows. You must keep paying property taxes and insurance and keep up the home, and the loan becomes due when you move out. The CFPB says there is a three-day right to cancel after closing, and warns about contractors who pressure homeowners into reverse mortgages for repairs. It also says a reverse mortgage "is not free money." We do not list reverse mortgage lenders, and this is not a recommendation for or against one.

What you'll need

  • A benefit statement or award letter, or bank statements that show the deposits, as proof of income.
  • A photo ID and an open checking account in your name.
  • Your address and phone number. Never give a Social Security number, bank login or card number to someone who contacted you first.
  • A list of your monthly bills, so you can see what is left after the payment.

Ask the lender for the total you will repay, in dollars, before you sign.

Options to consider first

These are general options, not recommendations of a particular provider:

  • Eldercare Locator. A public service of the Administration for Community Living that connects older adults and families to community services. Call 1-800-677-1116 (calls and texts accepted) or use eldercare.acl.gov, checked October 11, 2026.
  • The CFPB's older-adult resources. Guides on debt, housing and retirement, plus help responding to elder financial abuse, at consumerfinance.gov.
  • A credit union PAL. Federal credit unions can offer payday alternative loans of $200 to $1,000 over 1 to 6 months, with an application fee of at most $20 (12 CFR 701.21(c)(7)). Ask whether a credit union near you offers them and whether you can join.
  • Talk to the biller first. A utility, landlord or hospital billing office may offer a plan. Ask before the due date.
  • 211. Call 211 or visit 211.org for local help with rent, utilities and food.

Frequently asked questions

Can a lender refuse me because of my age?

Under Regulation B a creditor may not take your age into account if you can enter a binding contract, with narrow exceptions (12 CFR 1002.6(b)(2)). It may still look at your income, debts and credit history.

Does Social Security retirement income count as income?

A creditor may not discount income because it is a pension or other retirement benefit, but it may consider the amount and how long it will probably continue (12 CFR 1002.6(b)(5)). Each lender decides which documents it accepts.

Is there a loan I can get only because I am over 62?

The CFPB says homeowners aged 62 and older can get a Home Equity Conversion Mortgage, the most common reverse mortgage. It uses your home as collateral and its balance grows over time.

How can I tell a scam loan from a real one?

The FTC says warning signs include upfront fees, a guarantee before any credit check and unsolicited calls offering credit. Check the lender's registration with your state attorney general or banking regulator.

Who do I call if someone is taking advantage of an older relative?

The CFPB lists help for responding to elder financial abuse, and the Eldercare Locator at 1-800-677-1116 can point to local services. If someone is in immediate danger, call 911.
