Loans for Gig Workers and the Self-Employed
Sometimes. A gig worker or self-employed person can borrow, but the lender has to see income it can verify, and income that changes every month is harder to document than a paycheck. Each lender sets its own rules about what it accepts. Some states also cap a loan at a share of your gross monthly income, which means the way you document your income matters. This guide covers the IRS forms that show self-employed income, the rules lenders must follow, cash-advance apps as a category, and state income limits.
The IRS forms behind gig and self-employed income
You may have several forms. Each one shows different money, and none is a pay stub.
- Form 1099-K. The IRS says it reports payments you received for goods or services during the year, through payment cards and third-party settlement organizations such as payment apps. The IRS page says reporting applies when payments for goods or services total over $20,000 in more than 200 transactions, though organizations may issue forms below that. It also says you must report income on your return whether or not you receive a form, and that personal payments such as gifts or reimbursements from friends and family should not be on a 1099-K and are not taxable income (IRS page reviewed June 28, 2026).
- Form 1099-NEC. The IRS says it is used to report nonemployee compensation: payments to independent contractors and other nonemployees (IRS page, updated June 7, 2026).
- Schedule C (Form 1040). Reports income or loss from a business you operated or a profession you practiced as a sole proprietor. The IRS says an activity is a business if its primary purpose is income or profit and you do it with continuity and regularity (IRS page reviewed June 28, 2026).
Gross receipts are not profit. Schedule C subtracts business expenses, so the net profit it shows can be much lower than the total on your 1099s. A lender looking at your tax return will see the net number, and some state limits are written in terms of gross monthly income, so it helps to know which number you are being asked about.
Taxes and records
The IRS Self-Employed Individuals Tax Center says self-employed people file annual returns and pay estimated taxes quarterly, using Form 1040-ES. You are required to file if your net earnings from self-employment were $400 or more. You also pay self-employment tax, which covers Social Security and Medicare, and you report it on Schedule SE (IRS page updated September 27, 2026). Keeping your 1099s, bank statements and invoices in one folder makes it much easier to show a lender the same income the IRS sees.
What federal credit rules say about your income
Regulation B says a creditor may not discount or exclude income because it comes from part-time employment, an annuity, pension or retirement benefit. It may consider "the amount and probable continuance of any income" (12 CFR 1002.6(b)(5)). Gig income often is irregular, so lenders may average it over several months or ask for more months of records. The rule does not tell lenders which method to use.
Cash-advance and earned-wage-access apps
Earned wage access (EWA) and cash-advance apps let you get money before payday. They are a different category from a licensed payday loan, and the law is still developing.
On December 23, 2025, the CFPB published an advisory opinion on EWA. It says what it calls "Covered EWA" is not credit under Regulation Z. To be covered, a product must meet several conditions, including these (from the opinion's text):
- Transactions do not exceed the accrued cash value of the wages the worker has earned, based on payroll data.
- The provider is repaid through a payroll process deduction at the worker's next payroll event, and not by debiting the worker's regular account afterwards.
- The provider tells the worker, and warrants in the contract, that it has no legal or contractual claim against the worker if the deduction falls short, and will not engage in debt collection or report to a consumer reporting agency.
- The provider does not assess the credit risk of individual workers, including through credit reports or scores.
The opinion says it does not state that products that are not Covered EWA are credit under Regulation Z, and that it interprets nothing outside Regulation Z. Whether a particular app meets the conditions, and how it treats someone who is paid as an independent contractor rather than through payroll, is something we do not decide. Read the app's own terms.
Our directory tags 12 brands as earned wage access or cash advance. All are recorded as online-only: Dave, MoneyLion, Chime (SpotMe / MyPay), Brigit, FloatMe, EarnIn, Tilt, Current, Varo, Cleo, Albert and Klover. This is a fact about our listings, not a statement of who accepts gig income or how each one works. See all of them on our brands page.
What six cash-advance apps say about amounts and fees
These are each app's own words, from its own pages (checked October 2026). They describe the app in general, not what you will be offered. Apps set limits per user.
| App | Advance amount | Fast delivery fee | Monthly subscription | Repayment |
|---|---|---|---|---|
| Albert | "Instant advance limits range from $25 to $1,000" (source) | not stated in our data | none stated in our data | "Cash advances are due 6 days from when you initially advance" (source) |
| Cleo | "Advance amounts range from $20 to $250" (source) | "express fee that ranges from $4.49 - $14.99" (source) | "Plus is subject to a $5.99 per month subscription fee, Pro is subject to a $8.99 per month subscription fee, and Builder is subject to a $14.99 per month subscription fee" (source) | "Your money will be automatically taken from your connected card or account on your repayment date" (source) |
| Current | "you can spot yourself with up to $1,000" (source) | "The fee will vary depending on the size of the advance you're taking" (source) | none stated in our data | "repayment should be collected automatically from that deposit" (source) |
| EarnIn | "Access up to $200 /day, with a max of $1,000 per pay period" (source) | "Lightning Speed 3 transfers start at $3.99" (source) | none stated in our data | "Any earnings & optional tips are repaid when your paycheck hits" (source) |
| Klover | "You can get up to $750 of your paycheck early with Klover" (source) | "you can pay a small express fee to get it delivered to your account instantly" (source) | none stated in our data | "repayment happens automatically on your next payday" (source) |
| Tilt | "Cash Advances range from $10–$500" (source) | $1 to $8 by advance size, 3% of the advance at $300 or more, per Tilt's terms | "Tilt charges an auto-recurring $8/month subscription fee" (source) | "Repay automatically when you're paid" (source) |
A few more points, also in each app's words. EarnIn says "New users typically begin with $20-$100 per day" and that it "runs on optional tips." Cleo says it "is prohibited by law from soliciting, accepting, or retaining any tip," and Current says it "will not ask for additional tips or charges on your Paycheck Advance." Cleo, Current, EarnIn, Klover and Tilt each say standard delivery is free but slower; Cleo, for example, says "the standard option is free and your cash arrives in 3-4 days." Two apps name states they do not serve: Cleo says you can't request a cash advance in Connecticut or Maine, and Tilt says its "Cash Advance is not available to Connecticut, Maine, or Washington, D.C. residents."
A small fee on a short advance can still be a high cost for the time. Our guide on how APR works shows how to compare a fee with a yearly rate.
What you'll need
- Recent 1099-NEC and 1099-K forms, and your last tax return with Schedule C, if you have one.
- Bank statements that show regular deposits from the platform or your clients, often for several months.
- Invoices or the platform's earnings summary.
- A photo ID and an open checking account in your name.
- Your monthly expenses, so you can see what you can repay.
Ask the lender which documents it accepts for self-employed income. Some states set the proof for you; see the table.
State rules that can matter
If your state caps a loan by gross monthly income, a lender has to judge your income before it lends, even when that income varies. Not every state has this kind of rule; for payday availability, see where payday loans are legal.
| State | What the rule says | Law |
|---|---|---|
| Washington | Outstanding small loans from all licensees combined cannot exceed 30 percent of the borrower's gross monthly income (or $700, whichever is lower). | Wash. Rev. Code § 31.45.073(2) |
| Idaho | A payday lender cannot make a payday loan that exceeds 25 percent of the borrower's gross monthly income when the loan is made. | Idaho Code § 28-46-413(2) |
| Indiana | A lender cannot make a small loan if its principal and charges plus the borrower's other small loan balances exceed 20 percent of monthly gross income. | Ind. Code § 24-4.5-7-402(1) |
| Nevada | A deferred deposit loan, with other outstanding loans, cannot exceed 25 percent of expected gross monthly income; the monthly payment on a high-interest loan is held to 25 percent too. | Nev. Rev. Stat. 604A.5017(1); 604A.5045(1) |
| Virginia | Before a short-term loan, the lender must make a reasonable attempt to verify income, with a document dated within 45 days. | Va. Code Ann. § 6.2-1818.4 |
| Utah | A deferred deposit lender must inquire whether the borrower can repay in the ordinary course. | Utah Code § 7-23-401(1)(g) |

Options to consider first
These are general options, not recommendations of a particular provider:
- A credit union PAL. Federal credit unions can offer payday alternative loans of $200 to $1,000 over 1 to 6 months. The application fee is at most $20 (12 CFR 701.21(c)(7)). The rule mentions verifying employment with two recent pay stubs as an example of underwriting, so ask what a credit union accepts if you are paid by 1099.
- Your platform's or client's payout options. Read their terms for how fast and at what fee you can be paid. We do not hold facts on these.
- Ask the biller for time. A landlord, utility or medical office may agree to a plan if you call before the due date.
- 211. Call 211 or visit 211.org for local help with rent, utilities and food.

Frequently asked questions
Can I use 1099 income to get a loan?
Some lenders accept it and some do not. Lenders may not discount income because it is part-time work, and may consider its amount and probable continuance (12 CFR 1002.6(b)(5)). Ask which documents the lender wants.
Is a 1099-K the same as my income?
No. The IRS says it reports payments received for goods or services through cards and payment apps, and that gifts and reimbursements from friends and family should not be on one. Your profit is shown on Schedule C.
Do I need a tax return to prove self-employed income?
Not always. Lenders often ask for bank statements, 1099s or invoices as well. It is the lender's choice, within its state's rules.
Are cash-advance apps loans?
It depends on the product. The CFPB's December 2025 advisory opinion says Covered EWA, as it defines it, is not credit under Regulation Z. It does not say that products outside that definition are credit.
Do I have to pay taxes on gig income if I did not get a 1099?
The IRS says you must report income on your return whether or not you receive a form. It also says you must file if your net earnings from self-employment were $400 or more.
