Are Payday Loans Legal in Georgia? Title Loans and Other Options
No. Payday lending is illegal in Georgia. Under O.C.G.A. § 16-17-2, it is unlawful to make, offer or arrange loans of $3,000 or less unless the lender operates under an exempt law, such as a bank, credit union, the Georgia Installment Loan Act or pawn. That is why you see title and installment lenders in Georgia but no payday stores.
Our directory lists 358 stores in Georgia: 185 installment loan stores, 170 title loan stores and 3 pawn shops. It lists no payday stores. The rest of this guide explains which law each product sits under.
What Georgia's payday law says
The law defines payday lending broadly. It covers all transactions in which funds are advanced to be repaid at a later date, whatever other elements the transaction contains (O.C.G.A. § 16-17-1(a)). The ban also reaches advances disguised as check cashing, sales or agency arrangements.
The penalty is serious for lenders. Making an unlawful payday loan is a misdemeanor of a high and aggravated nature, punishable by up to one year in jail or a fine of up to $5,000, or both, and each loan is a separate violation (§ 16-17-2(d)). We have not yet confirmed this in the official statute text, so read the statute or ask the Department of Banking and Finance.
Georgia also sets a general ceiling on interest. Charging more than 5% a month is criminal usury, a misdemeanor, though licensed pawnbrokers are limited only by the pawn statute (O.C.G.A. § 7-4-18(a)). For a loan of $3,000 or less not made under another law, the rate cannot exceed 16% a year in simple interest (§ 7-4-2(a)(2)). Our Georgia payday page shows the ban.
Title loans in Georgia
So why are there title stores? Georgia title loans are pawn transactions on a vehicle title. The pawn statute sets the limits:
- Term: a pawn transaction runs 30 days and can be extended for further 30-day periods (O.C.G.A. § 44-12-131(a)(1)).
- Charges, first 90 days: interest and pawnshop charges of at most 25% of the principal for each 30-day period (§ 44-12-131(a)(4)(A)).
- After 90 days: at most 12.5% of the principal for each 30-day period (§ 44-12-131(a)(4)(B)).
- No leaseback: the pawnbroker cannot lease the vehicle back to you. You keep the vehicle, but the lender holds the title (§ 44-12-131(a)(2)).
A worked example
Our arithmetic: on a $1,000 title loan, the charge can be up to $250 for each 30-day period in the first 90 days. If you pay only the charge each month for three months, that is up to $750 and you still owe the $1,000. After day 90 the cap falls to $125 a month. Over a year of 30-day periods, the top rate works out to a very high APR (annual percentage rate). Our guides on title loans and on how APR works walk through the math.

Installment loans in Georgia
Making installment loans of $3,000 or less requires a license under the Georgia Installment Loan Act, unless the lender is exempt, such as a bank, credit union or pawnbroker (O.C.G.A. § 7-3-4(a)-(b)). You may prepay at any time, and if you pay in full early you get a refund of unearned interest (§ 7-3-14). The Georgia Department of Banking and Finance (DBF) lists these lenders.
We list 185 installment loan stores in Georgia. By brand, 107 are World Finance, 50 OneMain Financial and 28 Republic Finance. See installment loans vs. payday loans for how the two differ.
Pawn shops in Georgia
The same pawn statute applies to ordinary pawn loans on goods. We list 3 pawn shops in Georgia. Ask the shop for its written terms before you leave an item.
How to check a lender's license
Start with the Georgia Department of Banking and Finance installment lenders page. We do not hold a direct search link for it. An online "payday" offer from a lender that is not licensed or exempt in Georgia is a warning sign, because the law bars even arranging such loans. Our online lenders page for Georgia shows what we know.

Options to consider first
These are general options, not recommendations of a particular provider:
- A credit union. Federal credit unions may offer payday alternative loans (PALs). PALs I are $200 to $1,000 over 1 to 6 months, and PALs II reach $2,000 over 1 to 12 months, with an application fee of $20 at most (12 CFR 701.21(c)(7)). Credit unions are among the lenders the Georgia ban exempts.
- Ask about a payment plan. Ask the landlord, utility or clinic you owe whether it offers more time or a plan, before the bill is due.
- 211. Call 211 or visit 211.org for local help with rent, utilities and food.
- Think before using a car title. A title loan holds your vehicle's title as collateral for monthly charges that can reach 25% of principal.
