Austin's payday and title loan ordinance
Austin is one of the Texas cities that limit payday and auto title loans by local ordinance (Austin City Code ch. 4-12, art. 2 § 4-12-10 and art. 3 §§ 4-12-20, 4-12-22). Under the ordinance:
- Credit access businesses must register with the city.
- A payday loan, including all fees, cannot exceed 20% of the borrower's gross monthly income.
- An auto title loan cannot exceed the lesser of 3% of gross annual income or 70% of the vehicle's retail value.
- Installment loans are limited to 4 payments, each paying down at least 25% of the principal.
- Single-payment loans can be renewed at most 3 times, and each renewal must reduce the principal by at least 25%.
