San Antonio's payday and title loan ordinance

San Antonio is one of the Texas cities that limit payday and auto title loans by local ordinance (San Antonio City Code ch. 16, art. XVI, §§ 16-900 to 16-900.12 (restrictions: § 16-900.10)). Under the ordinance:

  • Credit access businesses must register with the city.
  • A payday loan, including all fees, cannot exceed 20% of the borrower's gross monthly income.
  • An auto title loan cannot exceed the lesser of 3% of gross annual income or 70% of the vehicle's retail value.
  • Installment loans are limited to 4 payments, each paying down at least 25% of the principal.
  • Single-payment loans can be renewed at most 3 times, and each renewal must reduce the principal by at least 25%.
